Think your body can handle 2 beers before driving? Think again

by | Dec 21, 2017 | Drunk Driving

There’s a myth among drivers that they can drink a couple beers on a full stomach, drink a coffee and be ready to rock-and-roll behind the wheel of an automobile. However, this is a myth and it’s simply not true. The only way that New Jersey drivers can virtually guarantee that they don’t get charged with a DUI is to avoid drinking any amount of alcohol before driving.

Although it’s known that Breathalyzer tests are not entirely accurate, officers will act upon a test result that shows the driver has over .08 percent blood alcohol content (BAC). Even if the driver appears to pass his or her field sobriety test with flying colors, if the officer sees the driver has red, bloodshot eyes (a condition that many of us suffer from due to sleep deprivation), has failed the Breathalyzer and has a hint of alcohol on the breath, the officer could arrest the person.

Some people think they can fool a Breathalyzer. They’ll swish mouthwash, eat a piece of garlic or an onion — or suck on a penny. These so-called “tricks” do not work. The Breathalyzer device is sensitive and it picks up the slightest traces of alcohol the come out of the breath through the lungs.

If you’ve had any amount of alcohol, the safest bet is to simply get a ride home. Take an Uber, take a taxi, stay the night at your friend’s house or get someone else to drive you home. The risk of getting charged with a DUI simply is not worth it.

If you’re reading this article and it’s too late to avoid drinking and driving by getting a ride home — and you’ve already been charged with a DUI — you may want to learn about your legal rights and criminal defense options. You may be able successfully defend yourself against your charges in some circumstances, and it’s important to evaluate your options in this regard.
