Man charged after deadly crash

by | Oct 15, 2015 | Felony DUI

Authorities say that a 29-year-old man faces multiple charges in connection with an accident that took place at 7 a.m. on Oct. 11. The crash took place near Old Bridge, New Jersey, near mile marker 122.3 of the Garden State Parkway. According to police, the man’s Yukon sports utility vehicle overturned, which caused the death of a 28-year-old passenger in the vehicle.

Both the driver and the deceased passenger were ejected from the vehicle, and police say that two other passengers were also hurt. The man was charged with DWI, vehicular homicide and two counts of assault by auto. However, there were no details as to why police believed that he was under the influence of alcohol at the time of the crash.

A driver who is convicted of a DWI will likely face significant legal penalties, especially if another person has been killed in a resulting accident. The possible penalties received at sentencing could include incarceration, a fine or a license suspension or revocation. In addition, a conviction on an impaired driving charge may also make it harder to get a job or keep the job that an individual may already have. Therefore, it may be worthwhile to consult with a DWI defense lawyer to help dispute the charge.

An attorney may be able to argue that a driver was suffering from a medical condition that mimics the effects of alcohol. It may also be possible to cast doubt upon physical evidence or witness testimony following a traffic stop or car accident. In some cases, this may be enough to get the charge dropped or reduce the charge through a plea agreement. This may enable a defendant to avoid some or all of the penalties related to a DWI.
