In New Jersey, penalties for a first time offense DUI/DWI depend on the driver’s Blood Alcohol Content (“BAC”) and whether the driver using drugs in addition to alcohol. If the driver’s BAC was between .08 and .09 and no drugs were involved, a conviction will result in: (1) A fine of $250-$400; (2) Detainment 12 to 48 hours; (3) Jail up to 30 days; and (4) 3 month license suspension. If the driver’s BAC was .10 or higher OR you were using drugs, a conviction will result in: (1) A fine of $300-$500; (2) Detainment 12 to 48 hours; (3) Jail up to 30 days; and (4) License suspension between 7 months and 1 year.
