New Jersey Appeals Process
If you have been convicted of a crime then you have the right to appeal. In order to file an appeal you must file a notice of appeal with the city clerk’s office. Then you must obtain the transcripts from your trial and mail them to both the court and to the prosecution. You must then write an appellate brief explaining why the judgment is improper. Not all reasons will be deemed grounds for an appeal so it is important to speak with an experienced lawyer to determine whether an appeal is right in your case. The rules which apply to the appeals process depend on the crime or offense for which you were convicted. For example, if you were convicted of a traffic offense in municipal court, you have 20 days to file an appeal, but if you were convicted of a crime in county court, then you have 45 days from the day the final judgment was entered to file the appeal.
