What Are Amphetamines?
Amphetamines are drugs that have a stimulant effect on the central nervous system. There are several classes of amphetamines including methamphetamines which carry higher penalties than many prescription drug amphetamines like adderall, dexadrine, Benzedrine, and Ritalin. Street names for all amphetamines include: bennies, black beauties, bumble bees, co-pilots, crank, cross tops, crystal meth, dexies, footballs, hearts, hot ice, ice, L.A. glass, meth, MDMA, pep pills, speed, uppers, lid poppers, or white crosses.
Possession Of Prescription Amphetamines In New Jersey
In New Jersey, it is illegal to possess amphetamines unless lawfully prescribed by a licensed physician. Charges vary based on the amount of drugs in possession.
- Possession in an amount of five or more dosage units is a Fourth Degree Crime which carries penalties of up to 18 months in prison and $10,000 in fines.
- Possession in an amount of four or fewer dosage units is a Disorderly Persons Offense which carries penalties of up to 6 months in prison and $1,000 in fines.
Distribution Of Prescription Amphetamines In New Jersey
In New Jersey, it is illegal to distribute amphetamines unless lawfully administered by a licensed physician. Charges vary based on the amount of drugs distributed.
- Distribution in an amount of four or fewer dosage units is a Disorderly Persons Offense which carries up to 6 months in prison and $1,000 in fines.
- Distribution for pecuniary gain in the amount of four or fewer dosage units is a Fourth Degree Crime which carries up to 18 months in prison.
- Distribution of at least five but fewer than 100 dosage units is a Third Degree Crime which carries penalties of 3 to 5 years in prison and a fine of up to $200,000.
- Distribution of 100 or more dosage units is a Second Degree Crime which carries penalties of up 5 to 10 years in prison and a fine of up to $300,000.
Under The Influence Of Amphetamines
It is illegal to be under the influence of a amphetamine without a prescription. In order to obtain a conviction, the state must only prove that the accused showed symptoms caused by the drug. The penalty for this charge is a Disorderly Persons Offense which carries up to 6 months in prison and $1,000 in fines. I can often have these charges diverted by entering the client into an alternative sentencing program like Conditional Discharge or Drug Court.
The De Minimus Defense
The De Minimus Defense is a defense against amphetamine distribution. It applies when an individual lawfully receives prescription drugs, but then gives some of those drugs to another person for that person’s personal use. In order for the defense to apply, certain elements must be present. To start, the defendant must be charged with Third Degree Distribution of Prescription Drugs. Additionally, the amount of drugs in issue can be no more than six dosage units distributed within 24-hours. Finally, the amphetamines must have originally been lawfully prescribed or administered and the distributer must have intended the distribution to be only for the receiver’s use.
