Possession of Ecstasy

Possession of Ecstasy in New Jersey is a third degree crime that carries penalties of 3 to 5 years in prison and up to $15,000 in fines. There are many ways to approach a defense, and the best way depends on the particular facts of the case. Distribution of Ecstasy

In New Jersey, the penalties for distribution of ecstasy are also the same for distribution of cocaine and heroine. Ecstasy pills are usually a combination of a drug called MDMA mixed with small amounts of heroine and/or cocaine. Like all drugs, penalties depend on the quantity involved. Take a look at the chart below to determine the applicable penalties.

Ecstasy Penalties

For 5 ounces or more:
1st degree crime, carrying 10 to 20 years in prison, and up to $500,000 in fines
For under 5 grams but more than ½ of an ounce:
2nd degree crime, carrying 5 to 10 years in prison
For less than ½ of an ounce:
3rd degree crime, carrying 3 to 5 years in prison, and up to $75,000 in fines

Parole Ineligibility

In addition to the penalties above, a conviction of distribution of ecstasy carries a minimum parole ineligibility period of between one-third and one-half the sentence so that if a person is sentenced to 10 years in prison, that individual must serve 3 to 5 years before becoming eligible for parole. Further, a penalty of $500,000 may be imposed in addition to the penalties fines in the chart above.
